General Terms
By placing an order with Next International, Inc. (referred to as “we” or “our”), you (the “customer”) agree to adhere to these Terms and Conditions. Any attempt by the customer to alter, modify, or supplement these terms will be null and void unless explicitly accepted in writing by Next International, Inc. These terms are subject to change without prior notice, so please review them each time you place an order.
Warranties
As an OEM manufacturer, Next International, Inc. offers custom computer systems assembled from third-party parts. While we provide warranty coverage on our systems, all individual parts are subject to their respective manufacturer warranties. Our warranty terms supersede all other representations. We disclaim all other express or implied warranties, including but not limited to warranties of merchantability and fitness for a particular purpose.
Limitation of Liability
Our liability is limited to the purchase price of the product. We are not liable for indirect damages, including but not limited to business interruption, data loss, or incidental or punitive damages, regardless of notice or the nature of the claim.
Payment Terms
Orders are not binding until accepted by Next International, Inc. Payment is due in full prior to shipment via accepted methods such as credit card or wire transfer. We reserve the right to refuse orders if payment requirements are not met.
Shipping, Handling, and Insurance
Shipping costs, including handling and insurance, are non-refundable and will be included in your invoice. Risk of loss passes to the customer upon delivery to the carrier. Estimated delivery dates are not guaranteed, and we are not liable for delays beyond our control, such as natural disasters or government actions.
Returns and RMAs
All returns require a Return Merchandise Authorization (RMA) number issued by our customer service team at 1-888-293-3889. Items returned without an RMA or with improper packaging may be refused. Customers are responsible for shipping costs for returns and may be subject to restocking fees depending on the condition of the returned items.
Governing Law and Jurisdiction
All disputes will be governed by the laws of Texas, with exclusive jurisdiction in the State Courts of Texas, Dallas County. Legal action against Next International, Inc. must be initiated within one year of the applicable invoice date.
Severability
If any provision in these terms is found unenforceable, the remainder shall remain in effect. Modifications that align with Texas law will apply where necessary.
